Paulsen discusses the unusual amount of media attention given to the Schiavo case, and contends that examining whether a defensible result was obtained in the one case can tell legal scholars a lot about how the system should respond in similar cases. He argues that state action that results in death under such circumstances cannot satisfy the due process clause of the US Constitution without proof beyond a reasonable doubt of the patient's wishes.
