The answer, Professor Paulsen argues, is yes, in the sense that Bentsen's appointment as Secretary of the Treasury is a flagrant and irremediable violation of the Constitution's "Emoluments Clause." How could such an obvious violation of the Constitution be so widely ignored, or worse, tolerated? Professor Paulsen speculates as to the lessons the Lloyd Bentsen affair teaches about whether the Constitution really should be taken seriously.
